Welcome to Fathr!
These Terms of Use ("Terms") govern your access to and use of the Fathr mobile application ("App" or "Service"), including the Fathr Wellness Coach AI, developed to help users track and visualize personal test data and receive general wellness education.
By accessing or using the App, you agree to be bound by these Terms. If you do not agree to any part of the Terms, you must not use the App.
1. Not Medical Advice
Fathr is not a medical or diagnostic application.
- The information, graphs, tips, and AI Wellness Coach responses are for general wellness, informational, and self-tracking purposes only.
- They are not intended to diagnose, treat, cure, or prevent any medical condition.
- The AI Coach provides only general lifestyle and fertility education (e.g., cycle tracking tips, nutrition, stress relief).
- Always consult a licensed physician or healthcare professional before making decisions based on data or suggestions from this App.
2. User-Provided Data
You may choose to:
- Upload sperm test results or other personal data
- Use the AI Wellness Coach by sending messages
By doing so, you:
- Confirm the information is your own and accurate
- Acknowledge that visualizations and AI responses are based on that data
- Understand this data is used solely to provide visual feedback, progress tracking, and general wellness education
- Agree that chat messages are sent (anonymized) to OpenAI to generate responses
We do not share, sell, or monetize your data.
3. AI Wellness Coach Usage
- The Fathr Wellness Coach is an educational AI powered by OpenAI.
- Your messages are anonymized before being sent to OpenAI.
- We do not store chat history on our servers unless you enable optional cloud sync (encrypted).
- You may report inappropriate AI responses in-app.
- OpenAI may retain anonymized data for up to 30 days for safety and training (see their Privacy Policy).
4. License to Use
Fathr grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes.
You may not:
- Reverse engineer, modify, or create derivative works
- Use the App to collect or store third-party data without consent
- Use the App in any unlawful manner or for illegal activity
- Attempt to bypass AI safety rules or prompt medical advice
5. Intellectual Property
All content, features, designs, and AI-generated responses within the App — including logos, branding, graphics, and UI/UX — are the exclusive property of Fathr or its licensors.
Unauthorized use, reproduction, or distribution is strictly prohibited.
6. Third-Party Services
The App uses third-party services, each with their own terms:

7. No Warranties
The Fathr App is provided "as is" and "as available" without any express or implied warranties, including:
- Fitness for a particular purpose
- Accuracy or reliability of data or AI responses
- Error-free operation or data loss prevention
We do not guarantee any fertility outcomes, health improvements, or AI accuracy.
8. Limitation of Liability
To the fullest extent permitted by law, Fathr and its developers shall not be liable for any:
- Direct, indirect, incidental, or consequential damages
- Decisions made based on App or AI-generated information
- Unauthorized access to your data
- AI responses that are inaccurate, incomplete, or unhelpful
You use this App at your own risk.
9. Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that:
- Violates these Terms
- Harms other users, us, or third parties
- Attempts to misuse the AI (e.g., jailbreaking, prompting harm)
10. Changes to These Terms
We may update these Terms at any time.
Changes will be posted in-app and on our website.
Continued use of the App after changes constitutes your acceptance.
11. Governing Law
These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles.
